How Is Air Quality Measured? Numbers That Trigger Legal Duties

Air quality figures are not merely informative. In most countries they are measured against legally binding limits, and exceeding them obliges authorities to act, which means the placement of monitors, the averaging period and the definition of a breach are legal questions as much as technical ones and are argued about accordingly.

What is measured

Regulation focuses on a small number of pollutants with established health effects, each measured differently:

  • Particulate matter, divided by size into fractions below ten micrometres and below two and a half, with the finer fraction penetrating deeper into the lungs and carrying the strongest association with mortality
  • Nitrogen dioxide, produced mainly by combustion and especially by diesel vehicles, which irritates airways and contributes to ozone formation
  • Ozone, which is not emitted directly but forms in sunlight from nitrogen oxides and volatile organic compounds, so it peaks downwind of cities on hot afternoons
  • Sulphur dioxide, historically the dominant urban pollutant from coal and now much reduced in most wealthy countries
  • Carbon monoxide, benzene and lead, all substantially reduced by fuel and vehicle regulation
  • Ultrafine particles and black carbon, which have strong health evidence and are not yet routinely regulated in most places

How the measurement is made

Reference monitoring uses expensive fixed stations with instruments defined in regulation, which is what legal compliance is judged against. Particulate mass is measured gravimetrically by drawing air through a filter and weighing it, or by equivalent automated methods calibrated against that. Gases are measured by techniques including chemiluminescence for nitrogen oxides and ultraviolet absorption for ozone, with regular calibration against certified gas standards. Siting is prescribed in detail, specifying distance from roads, height above ground and exposure, because a monitor placed differently returns a different number for the same air, and disputes about whether a site is representative are a recurring feature of enforcement cases. Low-cost sensors using optical scattering for particles and electrochemical cells for gases have proliferated and cost a fraction of reference instruments, and they drift, respond to humidity and cross-react with other gases, so they are valuable for mapping spatial patterns and for public engagement while not being accepted for compliance.

How limits are set

Health-based guidance comes from epidemiology relating exposure to outcomes including mortality, hospital admissions, asthma and birth weight, and the consistent finding across pollutants is that no threshold has been identified below which there is no effect, which makes any limit a judgement about acceptable risk rather than a safety line. Guidelines issued by the United Nations health agency were tightened substantially in 2021 on the strength of accumulated evidence, and they are advisory. Legal limits set by national and regional law are frequently less strict, reflecting what is considered achievable, and are expressed with an averaging period and an allowed number of exceedances, so a limit might be a maximum annual mean plus a permitted number of days above a higher hourly value. Those details matter enormously, since a pollutant that spikes briefly and a pollutant that is persistently moderate produce different compliance results from the same total exposure, and choosing the averaging period effectively chooses which problem is regulated.

What happens when limits are breached

Exceeding a legal limit triggers duties rather than automatic penalties. Authorities are typically required to produce an air quality plan showing how compliance will be achieved in the shortest possible time, and the adequacy of those plans has been litigated repeatedly, with courts in several countries ruling against governments for plans that were unrealistic or insufficiently urgent. Enforcement measures include low emission zones charging or banning older vehicles, which have produced measurable reductions where implemented, restrictions on solid fuel burning, industrial permit conditions and road layout changes. The gap between measured pollution and real exposure remains a weakness, since fixed monitors sample a few points while people move through varying concentrations, and personal monitoring studies find exposures that fixed stations do not capture. A coroner's inquest in Britain in 2020 recorded air pollution as a contributing cause of a child's death, which was the first such finding and shifted the legal framing from an environmental standard towards an identifiable harm to identifiable people.
